Information You Give To Us.

  • We collect the personal information you choose to share with us when you create an account with us and use our Services.
  • We collect information from you when you establish an account with us on your child’s behalf, as a parent or legal guardian. The information can include username and password and your contact information, such as name, email address, residential address, telephone number, or any other identifier by which you may be contacted online or offline, as well as a photograph.
  • We may collect your school information to promote your participation in a tournament.
  • We may collect information from you during e-sport practices and games, or during your participation in tournaments, such as statements and communications, or photographs.
  • We may collect information that you post.
  • We collect records and copies of your correspondence (including email addresses) if you contact us for Services you have purchased, such as tournaments you have signed up for, and your responses to questions or surveys that we might ask you to complete for research or business purposes, or to improve our Services.
  • We collect details of transactions you carry out through our Website or in connection with our Services in fulfillment of your requests or inquiries.
  • You may be required to provide financial information before establishing an account or registering for/participating in a tournament, or for other Services we may provide.
  • We may collect any search queries you make on our Website.
  • We may collect information you provide to be published or displayed on public areas of our Website, or during games, practices, and tournaments.

Other Information We Collect.

  • We may collect personal information about you via automated means when you visit our Websites, including information collected from cookies, connection and usage information, IP addresses, browsing activity, forms or fields you complete or partially complete, search terms, whether you open an email from us, content you view and the duration.
  • We may collect information relating to your performance during practices, games, or tournaments. We collect information on the Services you have purchased or the tournaments for which you have registered.
  • We may aggregate data to help improve our Services, including, without limitation our game-hosting platform, applications or Website experience for our users.
  • We may use artificial intelligence systems to monitor, record and report communication that occurs on our Discord servers.You expressly consent to the collection, monitoring, review, and caching of any information obtained by the AI System from or related to using Esports Tower websites, Discord servers, and other proprietary applications, including all communications to and from such applications used in the service of training, developing and hosting Esports Tower communities, events and programs.
  • We may also ask you for information when you enter a contest or promotion sponsored by us or our business partners or other third parties or when you report a problem with our Website or other Services.
  • We will collect your information for hiring-related purposes if you apply for employment with us.

Information We Collect From Third Parties. 

  • We may collect information from third parties whom you authorize to share information in connection with our Services.
  • We may collect information from other users of our Services, who may post materials that refer to or depict you.
  • We may collect your information from our service providers to better render our Services for you or to help with our operations and for fraud prevention.   • We may use your information to provide you with information and notices about your account or our other Services, including new tournaments and game schedules, expiration and renewal notices, or to better understand your needs.
  • We may use your information to improve the quality or your personal experience on our Website, game-hosting platform, or other aspects of our Services, or to analyze the success of our Services.
  • We may use your information to promote our Services and to promote your participation with them.

  • We may share your information with service providers to better our Services or for operational purposes, promotion of administration, and fraud prevention.
  • We may share information we collect, as appropriate, (i) with law enforcement or otherwise to protect and enforce the legal and contractual rights, privacy, and safety of us or of others; (ii) to protect against possible fraud or other illegal activity; (ii) to respond to requests from government and other authorities; and (iii) to comply with legal processes.
  • In the event that Esports or an affiliate is involved in a merger, acquisition, transfer of control, bankruptcy, reorganization or sale of assets, or diligence associated with such matters, we may sell or transfer the information described in this Privacy Policy as part of that transaction.

4. COOKIES AND AUTOMATED TECHNOLOGIES

Our Website uses cookies, which are small data files sent to your computer on the basis of the information that we have collected about your visit. You may access our game-hosting platform from a third-party website (i.e., a website owned or operated by another entity) (“Linked Sites”). Any such linking should not be construed as an endorsement by Esports. Linked Sites are not controlled by us; nor are they governed by this Privacy Policy. This Privacy Policy governs only personal information collected by Esports in connection with our Services. When visiting third-party websites, including Linked Sites, we encourage users to review the privacy policy governing such site.

6. LEGAL BASIS FOR PROCESSING

We collect, use, and otherwise process your information when we have a lawful basis, as follows:

  • Consent: We ask you for consent to collect or use your personal information for specific purposes, such as emails to you about special offers or competitions.

Esports is located and operates in the United States. If you are outside of the United States, it is necessary to transfer your personal information to and process in the United States where our central databases operate. By using our Website or Services, you (i) acknowledge that the data protection and other laws of the United States may provide a less comprehensive or protective standard of protection than those in your country, and (ii) you consent to your personal information being collected, processed, and transferred as set forth in this Privacy Policy.

8. YOUR RIGHTS AND CHOICES

If you have a question or would like to access and correct your personal information that you submitted to us when establishing your account, you may access, change, or delete the personal information in your account at any time by accessing your account.

If you prefer that we do not share personal information about you with our affiliates, or to non-affiliated third parties, for marketing purposes, except as otherwise permitted or required by law, you may direct us not to do so by contacting us. If you prefer that we do not direct market to you via our affiliates and non-affiliated third parties through email, postal mail, or telemarketing, you may direct us not to do so by contacting us at privacy@esports.com.

9. JURISDICTION-SPECIFIC RIGHTS AND CHOICES

1. EEA, United Kingdom and Switzerland Residents

If you are a resident of the European Economic Area (EEA), United Kingdom, or Switzerland, you have the following data protection rights: right to access, rectification, deletion, restriction of processing, data portability, to object, and not to be subject to automated individual decision making. You can exercise any of these data protection rights by completing our Data Rights Request Form.

Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. If we collected and processed your personal information with your consent, you can withdraw your consent at any time by filling out our Data Rights Request Form. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

If personal information pertaining to you as an individual has been submitted to Esports by or on behalf of a Esports customer and you wish to exercise any data protection rights you may have with respect to that data under applicable law, including the right to access, port, correct, amend or delete such data, please inquire with the relevant Esports customer directly.

If you have any concerns or complaints about our collection and use of your personal information, you can contact the data protection authority in your jurisdiction.

2. California Residents

California Consumer Privacy Act (CCPA). The California Consumer Privacy Act of 2018 (“CCPA”), effective as of January 1, 2020, requires businesses that collect personal information of California residents to make certain disclosures regarding how they collect, use, and disclose such information. For a description of all of our data collection, sources, use and disclosure practices, please read this Privacy Policy in its entirety. Esports does not sell personal information as we understand sale to be defined by the CCPA and its implementing regulations.

California law gives California residents the right to make the following requests with regard to certain information we collect about them: (i) the right to request a copy of personal information we collected or disclosed for a business purpose over the past 12 months; (ii) the right to request deletion of personal information we collected, subject to certain exemptions; and (iii) the right to request that we disclose personal information we collect, use, and disclose.

You can submit a copy, deletion or right-to-know request online by completing our Data Rights Request Form. Esports will verify that the information you submit (which includes first name, last name, email address, company, and country/state) matches our records before we fulfill the request. You may use an authorized agent to submit a consumer rights request on your behalf using the methods above. However, Esports will require the authorized agent to provide signed permission to submit the request on your behalf and may still contact you to confirm your identity and that this request was submitted with your permission. Esports does not discriminate against you for exercising your rights or offer you financial incentives related to the use of your personal information.

California Shine the Light Law. California residents can request a list of all the third parties to which we have disclosed certain personal information (as defined by California’s Shine the Light law) during the preceding year for those third parties’ direct marketing purposes. 3. Nevada Residents

If you are a Nevada resident who has purchased goods or services from us, you may submit a request to opt out of any potential future sales under Nevada law by emailing us at privacy@esportstower.com. Please use “Nevada Do Not Sell” in the subject line. Note we will take reasonable steps to verify your identity and the authenticity of the request.  Once verified, we will maintain your request in the event our practices change.

4. Canadian Residents

The personal information we collect about you and your parents or legal guardians may include name, email address, relationship, and the required consent to participate in and share information through the Services. We rely on consent for the collection, processing and retention of your personal information. We also require that schools and educational institutions providing your information have obtained the required consent. You have the right to withdraw your consent at any time and the right to access personal information we hold about you. When you submit your information via our Services, you expressly consent to the collection and transfer of your personal information for the purposes identified in this Privacy Policy, and you understand that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, in which case we will have taken steps to ensure that the information, if transferred, receives an adequate level of protection.

10. CHILDREN’S PRIVACY

Our Services, including our game-hosting platform, are not designed to attract children aged thirteen (13) and under. Further, you must be eighteen (18) or older to use our Services or provide verifiable consent from your parent of legal guardian. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information, including any associated account, and prohibit use of our Services.
